Regulation 4 And 5 Of The Pms Agreement Regulations 2004

Regulations 3 to 8 of GMSCR 2004 provide for other provisions regarding the authorization to enter into a general medical services contract. The regulations act as in Section 44 of NHSWA 2006. A brief summary of the other requirements of GMSCR 2004 is presented below. Regulation 5 provides that, subject to exemptions under Rule 5, paragraph 3, paragraph 5, contracts cannot be entered into with a physician; a partnership or business in which one of the practitioners (or any other partner or co-owner, or partner or company itself): 1.Opt outs of out of hours services, to which the opt-out notification is notified after September 30, 2004. Section 47 of NHSWA 2006 stipulates that a general medical services contract must contain a provision imposed by Welsh ministers in the regulations. In particular, these provisions may include: the terms and standards of service delivery, the persons who provide services, the persons to whom the services are provided, the modification of the contractual terms, the entry and control fees, the circumstances and the manner in which the contract can be terminated, and the application and decision of disputes. All regulations adopted by Welsh ministers, in accordance with Section 47, must provide for the right of patients to choose the persons they are expected to receive services from. Regulations 11 to 26 of the National Health Service (General Medical Services Contracts) (Wales) Regulations 2004 (GMSCR 2004) provide for other necessary contractual conditions. The regulations act as stipulated in Section 47 of NHSWA 2006 and require: that contracts must contain conditions: the names of the parties, whether the contract should be considered an NHS contract, if a contract with a partnership should be considered a contract with the company that exists from time to time , the duration of the contract, essential and additional services (see above), whose contract must contain all the provisions of SFE 2013. Section 42 provides that an LHB may enter into a contract called a general medical services contract under which primary medical services must be provided.

The contract may make an agreed arrangement between the parties regarding the benefits to be provided, compensation under the contract and all other matters. Services to be provided under such a contract may include services other than primary health care and services that must be provided outside the LHB sector. Section 43 stipulates that the contract must require the person entering into the contract with LHB (the contractor) to provide the primary medical services prescribed by the Welsh Ministers` Regulations. Section 50 of the National Health Service (Wales) Act 2006 provides that an LHB may enter into agreements under which primary medical services are provided by someone (except the LHB). The agreements must be in line with the provisions of the Welsh ministers in Section 52 of the Act. Section 50 agreements are generally known as the Personal Medical Services Agreements (PMS Agreements) and are an alternative to the general medical services contracts described above.
